Flare Terms of Service
Flare is a Mature-rated 18+ dating, Live streaming, and user-generated content (UGC) platform for adults only.

These Terms of Service (“Terms”) govern your access to and use of Flare’s apps, websites (including flaresparkdating.com), and related services (the “Services”) operated by Christian Shumpert, sole proprietor (“Flare,” “we,” “us,” or “our”). Flare is a Mature-rated, 18+ dating, Live streaming, and user-generated content (UGC) platform for adults only. By creating an account, accessing, or using Flare, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
1. Eligibility (18+)
Flare is a Mature-rated platform for adult dating, Live streaming, and user-generated content (UGC). You must be at least 18 years old to create an account or use any Service. By using the Services, you represent and warrant that you are 18 or older and have the legal capacity to enter these Terms. We may require age verification and may suspend or terminate accounts that fail to meet this requirement.
2. Accounts
You are responsible for your account credentials and for all activity under your account. Provide accurate information and keep it updated. One person per account unless we expressly allow otherwise. Do not share your account, impersonate others, or create accounts to evade bans. We may refuse, suspend, or terminate accounts at our discretion for violation of these Terms, fraud, safety risk, or legal compliance.
3. Services overview
Flare provides Mature-rated 18+ social dating, messaging (including paid DMs), Live streaming, user-generated content (UGC), virtual coins and gifts, VIP features, Meetup Live / nearby features, and related tools. Features may change, be limited by region or platform, or be discontinued. We do not guarantee matches, relationships, earnings, or uninterrupted availability.
4. Conduct and Community Guidelines
You agree to follow our Community Guidelines and not to:
- Harass, threaten, stalk, or exploit others
- Post or stream illegal, non-consensual, or harmful content
- Scam, defraud, or solicit money under false pretenses
- Share others’ private information without permission
- Use bots, scrapers, or unauthorized automation
- Interfere with the Services or circumvent security or payments
- Violate applicable law or third-party rights
We may remove content, restrict features, withhold fraudulent payouts, and ban accounts for violations.
5. User-generated content (UGC) license
You retain ownership of content you create and share on Flare (including photos, bio text, Live streams, and messages you send), subject to these Terms. By posting or streaming content, you grant Flare a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify (for formatting), display, perform, distribute, and otherwise use that content as needed to operate, promote, and improve the Services. You represent that you have all rights necessary to grant this license and that your content does not infringe others’ rights. You can delete content or your account subject to residual copies in backups and legal retention.
6. Live streaming
Hosts are responsible for their streams and chat moderation within their control. Do not stream illegal activity, non-consensual intimate content, or content involving minors. Flare may monitor, interrupt, end, or remove streams and related chat for safety, policy, or legal reasons. Gift and tip activity during Live is subject to Section 7 and fraud checks.
7. Coins, gifts, VIP, and paid DMs
Coins are a limited license to virtual items and features inside Flare. Coins have no cash value outside the Services except where creator payouts are expressly offered under our rules. Except where required by law or by Google Play / Stripe policies, purchases are generally non-refundable once delivered.
Platform and payment methods
- Web: Coin packs, VIP, and similar paid digital goods are processed through Stripe.
- Android (native / Capacitor app): In-app purchases of coins and VIP must use Google Play Billing. Charging for digital goods inside the Android app via Stripe or other non-Play checkout is not permitted under Google Play policies and is a rejection risk.
- Spending already-purchased coins on gifts, Live tips, or paid DMs is a use of your wallet balance, not a separate store purchase of digital goods.
Revenue splits
- Live gifts: 30% Flare / 70% streamer (subject to fees, chargebacks, fraud review, tax, and law)
- VIP subscriptions and paid DMs: 100% platform revenue unless we state otherwise in a written agreement
We may reverse, withhold, or adjust balances and payouts for suspected fraud, chargebacks, policy violations, or technical errors. Pricing and pack offerings may change.
8. Meetup Live and offline safety
Meetup Live and nearby features are optional tools to discover people or places. Flare does not arrange, supervise, or guarantee any offline meeting. You are solely responsible for your safety offline. Meet in public places, tell a trusted person your plans, and never share financial information with strangers. Flare is not liable for conduct of users offline or for harm arising from Meetup Live or location features.
9. Moderation and enforcement
We may investigate reports, review content and accounts, remove or restrict UGC or Live, limit messaging or monetization, and suspend or terminate accounts. We may preserve information for safety, legal, and dispute reasons. Enforcement decisions are at our discretion and do not create an obligation to take any particular action in every case.
10. Intellectual property
Flare’s name, logos, design, software, and branding are owned by us or our licensors. You may not copy, reverse engineer (except where law prohibits that restriction), or create derivative works of the Services except as expressly allowed. Feedback you provide may be used by us without obligation to you.
11. Third-party services
The Services may integrate Google Play, Stripe, sign-in providers, hosting, analytics, and other third parties. Their terms and privacy policies apply to their services. Flare is not responsible for third-party outages, billing disputes handled by stores/processors (except as we facilitate), or third-party content.
12. Disclaimers
THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT MATCHES, LIVE, OR MEETUPS WILL MEET YOUR EXPECTATIONS. YOU USE FLARE AT YOUR OWN RISK.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLARE AND CHRISTIAN SHUMPERT (SOLE PROPRIETOR) WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, GOODWILL, OR SAFETY OUTCOMES ARISING FROM YOUR USE OF THE SERVICES OR INTERACTIONS WITH OTHER USERS (ONLINE OR OFFLINE).
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS (US $100) OR (B) THE AMOUNTS YOU PAID TO FLARE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.
14. Indemnity
You agree to defend, indemnify, and hold harmless Flare, Christian Shumpert, and our agents from and against claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your content, your use of the Services, your offline meetings, your violation of these Terms or law, or your infringement of others’ rights.
15. Termination
You may stop using Flare and request account deletion at any time. We may suspend or terminate access immediately for any reason, including Terms violations, inactivity, risk, or discontinuation of the Services. Upon termination, licenses granted to you end; provisions that by nature should survive (including IP, disclaimers, liability limits, indemnity, and governing law) will survive.
16. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms with a new effective date at https://flaresparkdating.com/terms. Material changes may be highlighted in-product or by email where appropriate. Continued use after the effective date constitutes acceptance where permitted by law. If you do not agree, stop using the Services.
17. Governing law and venue
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Exclusive venue for disputes arising out of or relating to these Terms or the Services shall be the state or federal courts located in Tarrant County, Texas, and you consent to personal jurisdiction there, except where applicable law requires otherwise (including mandatory consumer protections).
18. Miscellaneous
These Terms, together with the Privacy Policy and Community Guidelines, are the entire agreement between you and Flare regarding the Services. If any provision is unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, sale, or reorganization. No agency, partnership, or employment is created. Headings are for convenience only. Electronic communications satisfy writing requirements where permitted by law.
